1 Agreement to These Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you and Global Development Project Kenya, Inc. (“GDPK,” “we,” “us,” or “our”) governing your access to and use of our website at gdpkenya.org, including all services, content, and features offered through it (collectively, the “Website”).

By accessing or using the Website in any way — including browsing, submitting a donation, using our contact forms, commenting on blog posts, or making a purchase in our online shop — you represent that:

• You have read, understood, and agree to be bound by these Terms;
• You are at least 18 years of age, or are accessing the Website under the supervision of a parent or legal guardian who agrees to these Terms on your behalf;
• You have the legal authority to enter into this agreement personally or on behalf of any organization you represent.

If you do not agree to any part of these Terms, you must discontinue use of the Website immediately.

2 Who We Are

Global Development Project Kenya (also operating as Global Hearts Without Borders Network) is a nonprofit organization incorporated in the United States and registered in the Republic of Kenya. We are recognized by the IRS as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code.

Our mission is to extend love and hope across East Africa through programs in clean water, girls’ education, women’s empowerment, youth leadership, humanitarian aid, and child welfare. We have served communities in Kenya and the broader East African region since 1991.

3 Donations & Giving

GDPK operates a giving platform through our website to accept and process charitable donations. The following terms apply to all donations made through gdpkenya.org:

3.1 — Our Role

GDPK is the direct recipient and steward of all donations made through our website. Donations are used to fund our active programs in East Africa and related organizational operations in support of those programs.

3.2 — Donations Are Final

All donations made to GDPK are complete and final charitable gifts and are non-refundable. Once a transaction is processed, it cannot be reversed except in cases of duplicate charges, processing errors, or unauthorized transactions, which should be reported to us immediately at info@gdpkenya.org.

3.3 — Donor Designations

GDPK may provide donors the opportunity to express a preference for how their gift is used (for example, designating a gift toward Clean Water, Youth Empowerment, or a specific program). Please note the following:

• Designations are expressions of preference, not binding contractual obligations. GDPK will make good-faith efforts to honor stated preferences.
• GDPK retains full discretion to redirect funds where operationally necessary, particularly in the event a program is discontinued, fully funded, or replaced.
• Where a designation cannot be honored, GDPK will apply the gift to the area of greatest current need.
• Federal law prohibits charities from promising or providing goods or services in exchange for charitable contributions.

3.4 — Tax Deductibility

As a U.S. 501(c)(3) nonprofit (EIN 93-1730164), qualifying gifts made by U.S. taxpayers are tax-deductible to the extent permitted by law. A written gift acknowledgment will be emailed to the address provided at the time of donation. Donors are responsible for retaining this receipt for tax purposes. GDPK does not provide legal or tax advice — please consult your tax advisor regarding deductibility.

3.5 — Payment Processing

Payments are processed by our third-party partners PayPal and Stripe. By making a donation, you also agree to the applicable terms of service of the payment processor used. GDPK does not store your full payment card details on our servers.

3.6 — Recurring Donations

If you set up a recurring (monthly) gift, your payment method will be charged automatically on the same date each month until you cancel. You may cancel at any time by contacting us at info@gdpkenya.org or by managing your subscription through the PayPal or Stripe portal. Cancellation requests received before your next billing date will stop the following charge.

4 Website Use

Subject to your compliance with these Terms, GDPK grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial purposes — including learning about our work, making a donation, applying to volunteer, or reading our blog.

This license does not include the right to:

• Download or copy account information for the benefit of any other person or entity;
• Use data mining, robots, spiders, scrapers, or similar automated tools to extract data from the Website;
• Frame or use framing techniques to enclose any GDPK trademark, logo, or content without prior written consent;
• Use metatags or hidden text using GDPK’s name or trademarks without permission;
• Interfere with the proper functioning of the Website or its servers.

Any unauthorized use of the Website immediately terminates this license. GDPK reserves the right to suspend or terminate access for any user who violates these Terms.

5 Intellectual Property

5.1 — GDPK Owns Its Content

All content on the Website — including text, photographs, videos, field reports, logos, graphics, program descriptions, newsletters, and page layouts — is owned by or licensed to GDPK and is protected by U.S. and international copyright laws. The “Global Development Project Kenya,” “GDP Kenya,” and “Global Hearts Without Borders Network” names and logos are trademarks of GDPK and may not be used without prior written permission.

5.2 — Limited Permission to Share

You may share links to our website content on social media or via email for non-commercial purposes. You may not reproduce, republish, modify, or redistribute substantial portions of our website content — including our field reports, newsletters, or program photography — without prior written approval. To request permission, contact info@gdpkenya.org.

5.3 — Third-Party Marks

Trademarks, logos, and names of third parties referenced on our Website (such as PayPal, Stripe, CAFO, Candid, or GreatNonprofits) are the property of their respective owners and are used for identification purposes only. Their use does not imply endorsement of GDPK by those organizations, nor endorsement of those organizations by GDPK, beyond what is publicly stated.

5.4 — Photography & Field Imagery

Photographs, videos, and stories involving beneficiaries of our programs — including children, women, and youth participants — are shared with the informed consent of subjects or their guardians and in compliance with our child safeguarding and data protection policies. Reproduction of this imagery without written permission is strictly prohibited.

6 User Content

6.1 — Your Responsibility

If you submit any content to GDPK through our website — including blog comments, contact form messages, volunteer applications, feedback, or social media interactions — you are solely responsible for the accuracy, legality, and appropriateness of that content (“Your Content”).

6.2 — License You Grant to GDPK

By submitting Your Content to GDPK, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, adapt, publish, and display it in connection with our nonprofit communications — for example, using a donor testimonial in a newsletter or annual report, or a volunteer quote on our website. We will not use your content in a way that misrepresents your views or relationship with GDPK.

6.3 — Content Standards

Any content you submit must not:

• Be false, misleading, defamatory, or harassing;
• Contain spam, unsolicited advertising, or commercial solicitations;
• Infringe the intellectual property, privacy, or other rights of any person;
• Contain nudity, sexually explicit material, or violent content;
• Include photographs of another person without their consent;
• Violate any applicable law or regulation.

GDPK reserves the right to remove any content that violates these standards, at our sole discretion and without notice. We are under no obligation to pre-screen submitted content.

6.4 — Feedback

Any suggestions, ideas, or feedback you submit to GDPK (including via contact forms or email) are provided voluntarily and without any expectation of confidentiality or compensation. GDPK is free to use such feedback for any purpose without obligation to you.

7 Prohibited Conduct

The following activities are strictly prohibited on or through the GDPK Website. Violations may result in immediate termination of access and, where applicable, legal action.

GDPK reserves the right to cooperate with local, state, and national authorities in investigating improper or unlawful activities involving use of our Website. Such cooperation may require disclosure of personal information as permitted by our Privacy Policy.

GDPK does not control and is not responsible for the content, privacy practices, or terms of service of any third-party website. Third-party services currently integrated with our Website include PayPal, Stripe, YouTube (Google), Google Maps, and Candid (GuideStar). Each of these services is governed by its own terms of service.

9 Online Shop

GDPK operates an online shop at gdpkenya.org/shop where supporters can purchase items that support our mission. The following terms apply to all shop transactions:

• Pricing: All prices are listed in U.S. dollars and are subject to change without notice. Sales tax may apply depending on your location.
• Payment: Shop purchases are processed through our payment partners and are subject to their terms of service.
• Fulfillment: Physical goods will be shipped to the address provided at checkout. Digital products, where offered, will be delivered by email.
• Returns & Exchanges: If you receive a defective or incorrect item, please contact us within 14 days of receipt at info@gdpkenya.org. We will work to resolve the issue.
• Charitable Component: Proceeds from shop sales support GDPK’s programs in East Africa. Shop purchases may not be tax-deductible as charitable contributions depending on the value of goods received.

THE WEBSITE AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GDPK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

You agree to indemnify, defend, and hold harmless GDPK and its officers, directors, employees, volunteers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of any provision of these Terms;
• Your violation of any third-party right, including intellectual property, privacy, or proprietary rights;

GDPK reserves the right to assume exclusive defense of any matter for which you are required to indemnify us, and you agree to cooperate fully with such defense.

13 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in Duval County, Florida.

If you are located outside the United States, you may also be subject to local laws. Nothing in these Terms limits any consumer rights you have under the applicable laws of your country that cannot be waived by contract.

GDPK reserves the right to update, modify, or replace these Terms at any time at our sole discretion. We will indicate the date of the most recent revision at the top of this page.

If we make material changes, we will make reasonable efforts to notify active donors or registered users by email.
